These Terms of Use ("Terms of Use") govern access to and use of the website cashify.in (the "Website"), operated by Cashify Private Limited (formerly known as Manak Waste Management Private Limited), a company incorporated under the laws of India, having its registered office at 55, 2nd Floor, Lane-2, Westend Marg, Saidullajab, Gadaipur, Near Saket Metro Station, New Delhi – 110030 ("Cashify", "Company", "we", "us", or "our"). The Website enables users ("you" or "User") to browse and book gaming consoles and accessories ("Consoles") available for rent from third-party partners ("Partners") listed on the Website.

By accessing or using the Website, creating an account, or placing an order, you agree to be bound by these Terms of Use, our Terms and Conditions of Rental, and our Privacy Policy (together, the "Website Terms"). If you do not agree, please do not access or use the Website.

1. ELIGIBILITY

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to register on, or place an order through, the Website.
By using the Website, you represent and warrant that you meet the above eligibility criteria and that all information provided by you is true, accurate, and complete.

2. ACCOUNT REGISTRATION

You may be required to register an account using your name, mobile number, email address, and such other details as may be prescribed, and to verify the same by OTP or other means.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or misleading, or if we reasonably suspect fraudulent or abusive use of the Website.

3. NATURE OF THE WEBSITE AND ROLE OF CASHIFY

The Website acts as a platform through which Users can discover and book Consoles that are owned and supplied by independent third-party Partners. Cashify facilitates the booking and payment process but does not itself own, warrant, or guarantee the Consoles listed.
Pickup and delivery of Consoles, and their condition and functioning, are the responsibility of the relevant Partner, subject to Cashify's quality and service-level requirements applicable to Partners.
Nothing on the Website constitutes an offer or invitation by Cashify to sell any Console; all rentals are subject to acceptance and fulfilment by the relevant Partner as described in the Terms and Conditions of Rental.

4. ACCEPTABLE USE

You agree that you shall not:

use the Website for any unlawful purpose or in violation of any Applicable Law;
impersonate any person or entity, or misrepresent your affiliation with any person or entity;
upload or transmit any virus, malware, or other harmful code;
attempt to gain unauthorised access to the Website, its servers, or any systems or networks connected to the Website;
scrape, data-mine, or use any automated means to access the Website without our prior written consent;
use the Website to harass, abuse, or harm any Partner, delivery personnel, or other User;
reverse engineer, decompile, or attempt to derive the source code of any part of the Website.

5. INTELLECTUAL PROPERTY

The Website, including its design, text, graphics, logos, and software, is owned by or licensed to Cashify and is protected under applicable intellectual property laws. "Cashify" and associated logos are trademarks of Cashify Private Limited.
Nothing in these Terms of Use grants you any right or licence to use Cashify's trademarks, logos, or content except as expressly permitted for your personal, non-commercial use of the Website.

6. THIRD-PARTY LINKS AND CONTENT

The Website may contain links to third-party websites or services (including payment gateways) that are not owned or controlled by Cashify. We are not responsible for the content, privacy practices, or terms of any third-party website.

7. DISCLAIMERS

The Website and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted under Applicable Law, Cashify disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Cashify does not warrant that the Website will be uninterrupted, error-free, or free from viruses or harmful components.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by Applicable Law, Cashify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website.
Cashify's aggregate liability arising out of or relating to these Terms of Use shall not exceed the amount paid by you for the specific Order giving rise to the claim, save for liability arising from Cashify's gross negligence, wilful misconduct, or fraud, or as otherwise required under Applicable Law.

9. INDEMNITY

You agree to indemnify and hold harmless Cashify, its officers, employees, and Partners from any claims, losses, or damages arising from your breach of these Terms of Use, your misuse of a Console, or your violation of any Applicable Law.

10. SUSPENSION AND TERMINATION

Cashify may suspend or terminate your access to the Website, without prior notice, if you breach these Terms of Use, engage in fraudulent activity, or misuse the Website in a manner that harms Cashify, a Partner, or another User.
You may stop using the Website and request closure of your account at any time by contacting us as set out in Clause 13.

11. AMENDMENTS

Cashify may revise these Terms of Use from time to time by posting an updated version on the Website, with the "Last Updated" date revised accordingly. Continued use of the Website following such changes constitutes acceptance of the revised Terms of Use.

12. GOVERNING LAW AND JURISDICTION

These Terms of Use shall be governed by the laws of India. Subject to any arbitration clause in the Terms and Conditions of Rental, the courts at Gurugram, Haryana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms of Use.

Console Rental Service

These Terms and Conditions ("T&Cs") apply to every booking/order ("Order") placed by a customer ("Customer", "you") through [Website Name] (the "Website"), operated by Cashify Private Limited (formerly known as Manak Waste Management Private Limited) ("Cashify", "we", "us"), for the rental of gaming consoles and accessories ("Console(s)") supplied by independent third-party partners ("Partners"). These T&Cs are in addition to, and to be read with, our Terms of Use and Privacy Policy.

1. THE SERVICE

The Website allows you to browse Consoles listed by Partners, select a rental period, and place an Order, which is fulfilled by the Partner serving your delivery location.
Cashify facilitates booking and payment collection; the Partner is responsible for delivering the Console to you and collecting it at the end of the rental period, at the Partner's own cost.
Availability of Consoles is subject to confirmation by the Partner. Placing an Order and completing payment does not guarantee fulfilment until the Partner has accepted the Order; in the rare event a Partner is unable to fulfil an accepted Order, Clause 6 (Cancellations, Refunds and Non-Fulfilment) shall apply.

2. PLACING AN ORDER

To place an Order, you must select the Console, rental duration, and delivery address, and complete payment of the applicable Rent (and Security Deposit, if any) through the Website's payment gateway.
You must provide accurate delivery address and contact information. Cashify and the Partner shall not be liable for delayed or failed delivery caused by incorrect or incomplete information provided by you.
Upon successful payment, your Order details (name, phone number, delivery address, rental dates, and Console selected) will be shared with the Partner solely for the purpose of fulfilling your Order, as further described in our Privacy Policy.

3. PRICING AND PAYMENT

The Rent displayed on the Website is on a per-day basis and is inclusive/exclusive of applicable taxes as indicated at checkout. The total price payable, including any Security Deposit, shall be clearly displayed prior to confirmation of your Order.
All payments must be made online through the payment methods supported on the Website. Cashify does not accept cash payments for Rent.
Prices are subject to change without notice; however, the price applicable to an Order already confirmed and paid for shall not be affected by any subsequent price change.

4. SECURITY DEPOSIT

A refundable Security Deposit may be charged at the time of booking, as displayed at checkout, to secure against loss of or damage to the Console.
The Security Deposit shall be refunded to you within [7] business days of the Console being returned in good working condition, subject to Clause 7 (Condition, Damage and Loss).

5. DELIVERY AND RETURN

The Partner shall deliver the Console to your specified address within the time slot committed at the time of booking, and shall collect it at the end of the rental period (or on early return/extension, as applicable).
At delivery, you will be required to verify your identity (as prescribed) and to inspect the Console together with the Partner's representative, and to acknowledge the condition of the Console and accessories delivered (via photograph, video, or digital checklist).
At pickup/return, you shall make the Console reasonably available to the Partner at the agreed date/time. Repeated unavailability may attract a late-return fee as displayed on the Website.
Extensions to the rental period must be requested through the Website prior to the scheduled return date and are subject to Console availability and additional Rent for the extended period.

6. CANCELLATIONS, REFUNDS AND NON-FULFILMENT

Scenario	Policy
You cancel before the Order is accepted by a Partner	Full refund of Rent and Security Deposit.
You cancel after Partner acceptance but before delivery	Refund subject to a cancellation fee of upto 100% of the Rent, as displayed at the time of cancellation.
You cancel after delivery (early return)	Refund, if any, prorated for unused rental days, less any applicable early-return fee, at Cashify's discretion.
Partner is unable to fulfil an accepted Order	Full refund of Rent and Security Deposit; Cashify will make reasonable efforts to offer an alternative Partner/Console where available.

Refunds shall be processed to the original payment method within [7–10] business days of approval.

7. CONDITION, DAMAGE AND LOSS

You are responsible for taking reasonable care of the Console during the rental period and for using it only for its intended purpose.
Upon return, the Partner will inspect the Console against the delivery-time condition record. Any damage (beyond normal wear and tear) or loss/theft of the Console or accessories during the rental period shall be assessed, and the cost of repair or replacement, as reasonably determined, shall be deducted from your Security Deposit, with any excess amount separately charged to you through the Website's payment gateway.
You shall promptly report any malfunction, defect, or damage discovered during the rental period to Cashify's customer support, and shall not attempt to repair the Console yourself.
You shall not use the Console for any unlawful purpose, tamper with its hardware/software, or sub-rent, sell, or transfer it to any third party.

8. LIABILITY OF PARTNERS AND CASHIFY

Consoles are supplied and delivered by independent Partners. While Cashify holds Partners to defined quality and service standards, Cashify does not manufacture the Consoles and does not warrant against manufacturing defects beyond what is disclosed by the Partner at the time of listing.
In the event of a materially defective or non-functional Console, you should promptly notify Cashify's customer support, who will coordinate a replacement, repair, or refund with the Partner as appropriate.
To the maximum extent permitted under Applicable Law, Cashify's liability in respect of any Order shall not exceed the total amount paid by you for that Order.

9. PROHIBITED USE

You shall not use a rented Console:

for any commercial purpose (e.g., public gaming cafés, tournaments for profit) unless expressly permitted at the time of booking;
in a manner that violates any Applicable Law or third-party rights, including copyright in games/software;
in a manner likely to cause damage beyond normal wear and tear.

10. CUSTOMER SUPPORT AND GRIEVANCES

For any issue relating to your Order — delayed delivery, defective Console, billing discrepancy, or otherwise — please contact our customer support at play@cashify.in Complaints will be acknowledged within 48 hours and, save in exceptional circumstances, resolved within 1 month, in accordance with Applicable Law.
If you are not satisfied with the resolution provided, you may escalate the matter to our Grievance Officer, whose details are set out in our Terms of Use.

11. FORCE MAJEURE

Cashify and its Partners shall not be liable for any delay or failure in performance resulting from causes beyond their reasonable control, including natural disasters, pandemics, strikes, or governmental restrictions.

12. AMENDMENTS

These T&Cs may be updated from time to time; the version applicable to your Order is the one in effect at the time you complete payment for that Order.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These T&Cs shall be governed by the laws of India. Any dispute shall first be addressed through Cashify's grievance redressal mechanism. If unresolved, subject to your rights as a consumer under the Consumer Protection Act, 2019 (including the right to approach the appropriate consumer forum), disputes shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana.
